Rental Terms
All vehicle rentals are governed by a comprehensive Rental Agreement provided at the time of booking confirmation or vehicle pickup. This document outlines the specific terms, conditions, insurance coverage, fees, and your responsibilities associated with the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Vehicle Rental Requirements
- To hire a vehicle from Whitehaven, drivers must be a minimum of 21 years old, though age restrictions may differ based on the vehicle type, with extra fees applicable for those under 25. A valid, full driving license for the appropriate vehicle category is required, along with proof of identity and current address. Valid payment information and a security deposit must also be provided, along with any other requirements detailed in the Rental Agreement.
Booking and Payment Details
- Reservations can be made via our website, over the phone, or directly at our Dartford office. A deposit may be necessary to confirm your booking. Full payment along with a security deposit is generally required at the time of vehicle pickup. All prices are quoted in British Pounds (£) and include VAT when applicable. We accept major credit and debit cards, ensuring secure transactions through trusted payment processors.
Vehicle Pickup and Drop-off
- At the time of collection, please conduct a careful inspection of the vehicle and report any pre-existing damage without delay. A vehicle condition report will be prepared and requires your signature. The vehicle must be returned in the same condition as it was collected, accounting for normal wear and tear. Any new damage will be evaluated and additional charges may apply. Ensure the vehicle is returned with the same fuel level as when you received it; refueling fees will be incurred for lower levels. Late returns may result in extra charges, so please inform us in advance if you expect a delay. You will be responsible for any parking fines, traffic violations, or other charges that arise during your rental, along with an administrative fee.
Insurance and Liability Terms
- All rentals at Whitehaven include basic third-party insurance. Comprehensive coverage details and excess amounts are outlined in the Rental Agreement. Additional insurance options can be explored to lower your financial liability. Review these options thoroughly. You remain liable for any damage or loss up to the insurance excess, unless you opt for extra coverage. Damage resulting from negligence or misuse is your responsibility, regardless of insurance.
6. Modifications and Cancellations
Cancellation and amendment policies differ based on the type of booking and the notice provided. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows may incur additional charges.
7. Restricted Activities
Prohibited Uses of Rental Vehicle
- The vehicle must not be used for any unlawful purposes, including racing, rallying, off-roading, or similar risky activities. Transporting hazardous materials is prohibited. Sub-letting the vehicle or permitting unauthorized drivers is not allowed. Driving under the influence of alcohol or drugs is strictly forbidden. The vehicle should only be used as intended, adhering to passenger and weight limits, and must remain within the agreed geographical boundaries unless authorized otherwise.
Breach of these terms may lead to rental termination and extra fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Whitehaven Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, nor for loss of profits, data, or business resulting from your use of our services. Our liability for any claim is limited to the rental amount paid in the past 12 months. This limitation does not apply to liability for death or personal injury due to negligence or fraud.
9. Applicable Law
These Terms are governed by the laws of England and Wales. Disputes will be resolved exclusively in English and Welsh courts.
Updates to Terms
Whitehaven reserves the right to update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
